Appeals Court Overturns Lifetime Sex Offender Registration
A Colorado appeals court has overturned a Jefferson County judge's order that imposed lifetime sex offender registration on a man without providing explanation.
David Lamont White pleaded guilty to attempted sexual assault in 2023. Despite an agreement between the defense and prosecution, District Court Judge Lindsay VanGilder did not make the required findings to justify lifetime registration.
Under Colorado law, individuals classified as "sexually violent predators" are subject to lifetime sex offender registration. The appeals court found that Judge VanGilder failed to provide the necessary findings to support this classification.
Colorado's second-highest court overturned the order after the judge did not make findings about each of the required factors.
